Terms of Service

1. Acceptance of Terms

By accessing or using Merry-Go, you agree to be bound by these Terms. If you do not agree, do not use the platform.

2. Services Provided

Merry-Go is a contribution management platform for chamas, savings groups, fundraising campaigns, and community financial organizations.

3. Not a Financial Institution

Merry-Go is NOT a bank, wallet, or financial institution. We do NOT hold, store, or process member funds. All money movements happen directly via M-Pesa between members and treasurers through automated STK Push and B2C disbursement.

4. No Financial Liability

Merry-Go is not responsible for:

  • Disputes between members and treasurers
  • Misappropriation of funds by treasurers
  • Failed M-Pesa transactions
  • Losses arising from fraud or negligence
  • Delays in B2C disbursement

You contribute at your own risk. We recommend only joining groups with people you trust.

5. Service Fees

Platform service fee applies to contributions:

  • Contributions of KSh 100 or less: Free
  • Contributions KSh 101-233: KSh 7 flat fee
  • Contributions above KSh 233: 3% of contribution (minimum KSh 7)

The fee covers M-Pesa transaction processing, automated disbursement, and platform maintenance. The fee is displayed before you confirm any payment. By proceeding, you accept the fee.

6. Pro Subscriptions

Pro subscription fees are non-refundable except where required by law. Subscription renews automatically unless cancelled before the renewal date.

7. User Responsibilities

You agree to: provide accurate information, keep your PIN secure, not use the platform for illegal activities, not attempt to hack or disrupt the platform, comply with all applicable laws.

8. Acceptable Use

You may NOT use Merry-Go for money laundering, fraudulent groups, impersonation, spam, or accessing other users data.

9. Intellectual Property

All content, code, logos, and designs are owned by Merry-Go. You may not copy, modify, or redistribute without permission.

10. Termination

We may suspend or terminate your account for violations. You may stop using the platform at any time.

11. Disclaimer of Warranties

Merry-Go is provided "as is" without warranties of any kind, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, Merry-Go shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the fees you paid in the 3 months preceding the claim.

13. Governing Law

These terms are governed by the laws of Kenya.

14. Changes to Terms

We may update these terms. Continued use after changes constitutes acceptance.
